Also what level of UCMJ was it. The safe answer is apply for a morality waiver for the UCMJ. The board can not see your restricted file however they now do reviews for every promotion now and it is my understanding that the restricted file is looked at. Not sure if they go into your enlisted record though. Have you looked in your restricted file in IPERMs and looked to see if it is there or if you can see the UCMJ action? There is an example on the USAREC website. If you don’t submit one, you run into the risk of them finding it, which will instantly disqualify you from becoming a WO, but that’s a choice you must make. If you were E4 or below, the record of that offense is only kept for two years, or until you PCS. The Army generally does not hold an Article 15 against you as long as you had not promoted to E-5 or above. If you received it as an E-5, whether it is in your public or restricted file is at the discretion of the commander that issued the Article 15. If I had gotten it as an E5, I would assume that the selection board has access to your restricted file and come clean about it. If it was while you were E4 or below , I would be honest if they ask, but wouldn&#39;t volunteer that information. <br />From someone that has had to give more than one Article 15, if you were an NCO and I put it in your restricted file, it meant that I thought you had f**ked up and needed a lesson, but I thought that you were worth the effort to keep around. Your CO ensured that an alleged offense did in fact violate the UCMJ, an Army Regulations, an Army Policy, a lawful order, any local laws or some other rule that you had a duty to obey. So yes I&#39;d say a review board would look at this in a negative manner. A lot as others have stated is if this is private or public file. A board considers how you have grown, what you have achieved, and so forth, during the years following the incident. If you were rehabilitated from the incident, meaning additional derogatory information is absence during the subsequent time frame, you’ll be fine. You will need to address the incident honestly if required. The primary concern is related to the security clearance, but it related to the aforementioned context. Hope this helps. I’ve witnessed past matters force former WOs out as NCOs since they were beyond their RCP when it was discovered. Although it may seem counterintuitive, honestly is the best policy. Even if it prevents you from becoming a WO, it’s better than what can happen later on if it is discovered after the fact and you didn’t disclose it. That means that is stays with the unit you got it in. If you have changed units, changed states it is gone away. One of my soldiers asked me the same thing today. You should be fine, good luck!
