Will I be arrested if I don’t ship to basic in the national guard?

Im in the national guard and want to go active duty, why would the active duty recruiter tell me not to ship since the guard won’t release me if I would be put under arrest?

My dep contract says I'll be ordered to active duty if I don't show up to ship what's the chances of that? And can I be released if I only signed my first contract

The active duty recruiter is not in your National Guard chain of command. Either he’s telling you what you want to hear, or you are mishearing what he’s saying. The Guard has already made an investment; if you fail to report, the best thing you could expect is an entry level separation, and not because they’re being nice or lenient, but because they’ll want to remove you as expeditiously as possible. Even that is going to take some time. Good luck taking that separation anywhere else. You will have no hope getting in when any other branch figures out that’s what happened. More than likely, not showing up to ship will expose you to all sorts of UCMJ action. And no other branch will touch you.

There is a way to transfer from the Guard to AD. But it requires significant input from your chain, and it’s not something they are going to do right after you get back from AIT. You made a commitment, the Guard is going to expect a return on their investment before they release you to do something else.

The AD recruiter is an idiot and not an actual recruiter, nor does he have knowledge of Reaerve Component rules

In the Active Duty you don't really belong to the Military till you ship. In the Reserve Component you belong the day you sign. There is no Delayed Entry Program DEP in the Reserve Component, so there is no DEP separation.

If you are already in the national guard you should ask for a DD368.

The path you've chosen is the NG. Stick with it. Volunteer for all the orders you can get, get on deployments where you can and before you know it you are basically doing as much time on orders as Active Duty. Eventually the window to transfer AD will open, and when it does you'll probably be an NCO.
