What are your professional and personal views on the right and the duty of active and retired military to disobey illegal or unconstitutional orders? (Ref. UCMJ, Articles 90, 91, 92; and the Fourth Geneva Convention.)

For instance, in the event a sitting U.S. President loses an election in the electoral college, and as a means to stay in office declares martial law or invokes the 1807 Insurrection Act, should you obey such an order? Would you individually be willing to comply?

Let's have a frank and friendly discussion on this vital topic....

I think we all would like to think, "Nah, not me. I would never obey an illegal order." When it comes down to the nut-cuttin' most would go along. Does ANYONE really think the average Nazi soldier supported Hitler? I read a lot of the "loyal opposition's" messages, and I detect a sense that many of them consider the other side as lower life forms that should be eradicated. Oh crap. I just blew the Hitler-Nazi soldier analogy.

LTC (Join to see) Sir, you hit the nail on the head and as anyone can see, too many AD and Veterans took the bait to get into a political hassle. The civilian's question COULD be answered WITHOUT the political views as many didn't take into account that such an order would be THROUGH the JCS who most certainly would have run it through SJA or JAG ... AND the DOJ's AG to determin the legal and Constitutional correct path.

This is a stupid trigger question, meant to bring out the worst of debates amongst fellow Veterans, and those currently serving, who took the Oath to defend to the Constitution. It is not vital topic question that should be discussed and simply asked by some civilian, who does not know a damn thing about Military and its Laws, because Judah or whatever your name is never took the Oath or experienced a day in our US military. No cover profile for who they are? So, why are we even going to entertain this person who obliviously wants to create hostile intent on a debate that has already shown the immorality and blatant thievery of the American Election System? Judah you will not have my frank and friendly opinion, until you explain your true intent.

So, you want to compare apples to apples ... I'll bite; During the weekend of May 31, 2020 - hundreds rioted in front of the White House, upwards of 50 Secret Service agents were injured, fires were lit which also engulfed a nearby church, the perimeter was breached when rioters scaled the fence - and for the Presidents safety, he was moved to the underground bunker. THAT was an ACTUAL insurrection - if you don't believe me, you can read the events from the NY times and compare them against a Websters Dictionary.

SP"C Rock, why don't you get your stupid butt off this site until you get some brains. The demonstration that was held in front of the white house was a peaceful one. The then president wanted to have a photo shoot standing in front of the church, holding up a bible the wrong way, so he had the guard and police gas and shoot rubber bullets at the crowd to move them away so he could have the photo shoot. So, keep your stupid right wing statements to yourself. Don't tell me about your first amendment rights.
