Yeah, that's a great idea if you want to have every single trial overturned and the defendants released. Or did you forget that is what happened with the previous laws reached the Supreme Court?

Salim Hamdan is back in Yemen, after being freed. Shafiq Rasul is back in Britain. Yaser Hamdi was forced to renounce his American citizenship and is now in Saudi Arabia. Lakhdar Boumediene is now in France, with his family.

How many convictions did we get under the old, unconstitutional law? Wasn't it only 8, 6 of those by plea bargains, and haven't 3 of those convictions already been overturned? How many outside of Gitmo have been prosecuted? Isn't that number over 500?

Look, I get that you really have a thing for Gitmo and the Military Commissions, but they are ineffective. There have been 779 people held at Gitmo. After Bush released 532 of them and Obama released 198, and the handful that died (mainly by suicide), you have 41 prisoners left. Over half (26) have still not been charged with a crime before the commission.

So you want to go back to a system that is unconstitutional and that doesn't try to resolve any of the issues. Got it.

I want to go back to international law and our SOP on it, the Geneva Conventions and the Law of Land Warfare. Enough of PC BS pandering. You're either a lawful combatant or you're not. I object to unlawful combatant Islamists who want to kill us being given more legal privileges than a lawful combatant POW would enjoy.

MAJ Montgomery Granger - You can't go back. The guidelines that were in place during WWII aren't applicable anymore, they went away when we changed from the Articles of War to the UCMJ and MCM in 1950. Second, under the Geneva Convention, a detainee is either a PW or an unlawful combatant. If the are a UC, they may be tried under the laws of the detaining State, which means that in the United States, the Constitutional protections that apply to everyone also apply to the UC.

So take your pick. They are either PWs or UCs, but either way, you still have to follow the law, and if they are UCs, they get legal rights and privileges under American law.
