The President does have broad military powers yes: "“The president’s power is very broad; he can micromanage in nearly anything in the military, no matter how trivial,” said Eugene Fidell, who teaches military law at Yale Law School."

"Presidential power over the military runs deep and hits up against just two limits, he said: Congress and the Constitution.

A president cannot create policies that violate constitutional rights. "

"But the real boundaries of what a president can do as a commander in chief in the day-to-day operations of the armed forces have never been tested, experts say, because since the beginning of the republic the presidency has given the military broad deference in how it runs its affairs."

There has never been intervention by a President at THIS low of a level: "To be sure, presidents have sometimes involved themselves in the minutiae of making war. President Lyndon B. Johnson, for example, personally approved targets for B-52 bombing runs in Operation Rolling Thunder, during the Vietnam War.

But by and large presidents have steered clear of retail personnel actions like the decision to bestow or remove the Trident pin, so the question of whether it is legal has rarely been asked."

So there is no case because other Presidents know better than to be involved in things like this and let the military handle it.

SFC (Join to see) - Your looking at this too politically. Ignore completely what Trump did. Look at what the Navy Seal did and what the UCMJ court decided before Trump got involved. He was acquitted of all charges before Trump was involved via UCMJ with the exception of posing with a corpse (the only charge he was found guilty of). How that last count translates into WAR CRIME is anyones guess. Look at what happened to others before him that were punished for posing with a Corpse in GWOT.
The most they got was a letter of reprimand and forced retirement. Also, might add, Trump only got involved after a FOX GWOT War Infantry Veteran pleaded on air how unfair it was for the Navy to bug his lawyers phone as well as attempt to take his Trident (Pete Hegseth), he was joined by several Special Forces Veterans as well, demanding an investigation into the Navy's behavior. That is what moved Trump to intervene, he didn't just do it himself on his own as you imply above......he was openly petitioned.

SrA John Monette - This was not a UCMJ Court Verdict. UCMJ Court verdict acquitted the Seal of all charges before POTUS got involved except one. The one remaining charge the UCMJ punished him via forced retirement (last I checked he is still retired) and reduction in rank........thats it full stop. Trump restored his rank for retirement, thats the only part he got involved with initially until a Navy Admiral started this, lets go after his Trident Pin because he got his rank back. That was a Navy Flag Officers decision OUTSIDE OF UCMJ COURT. In past cases accused would be forced to retire at current rank with a letter of reprimand inserted into their personal file for desecrating a corpse. The part of revoking his rank and going after the Trident pin was clearly command influenced by the Navy. At any rate UCMJ had it's pass and Trump did not interfere in UCMJ except in restoration of rank and clearing of the last remainig charge. To me that is fair given what has happened in the past when someone desecrates a corpse they are forced out and given a letter of reprimand. So the argument was over taking his rank (and retirement money) along with his Trident and calling him a War Criminal for merely desecrating a corpse. Tell me what case in the past has that happened before? Completely unprecedented. Which caused other GWOT SF and Regular Army Veterans to start bitching on FOX about it which the President saw and started to ask questions..........then and only then did the POTUS intervene. Thank Pete Hegseth FOX and Friends (Former GWOT Combat 101st Airborne Infantry Platoon Leader) for starting the whole POTUS intervention with SF Veteran guests on his show..............thats how it got started. It wasn't POTUS rolling out of bed one day saying he was going to intervene in a military case all on his own.

This whole episode was started by GWOT Combat Veterans who petitioned the President on the Air of FOX NEWS. Are you saying they are full of it as well? One of them, Pete Hegseth (FOX and FRIENDS) Served with the 101st Airborne Rakkassans as a Infantry Platoon Leader in Iraq. Several other guests on the show were former SF Combat Veterans.........that also stated he was being treated unfairly by the Navy. Are they full of crap too? Should the POTUS have instead ignored the Veteran protests and said: "Oh well thats politics for ya"???

MSG Stan Hutchison - Easy to say if you have never worked at high levels of the U.S. Government. You have a LTC on this very same page saying it exists. Is he lying? I have seen aspects of it. Ever wonder why contract officers to the Pentagon pick the same contracting company year after year instead of going with the low bidder. It's because as the PM of the contract they don't want to go through radical change of changing people out. I can see how that would be interpreted as deep state. Can also see how mixing political appointees and civil service would cause problems in State Department. You do know they can flip between the two without much problem as a State Dept Employee. You can be appointed, POTUS changes and you can convert to Civil Service. Is that person suddenly objective now that they are Civil Service or do they still maintain their political loyalties and biases? Perhaps you should read the State Departments hand out on Foriegn Service Officer and Civil Service and see how interchangeable they are.
