MSG Stan Hutchison - whichever way the court decided - state or federal level, would have been in line with the constitution. That particular set of Judges, decided that it should be federal. something like that falls into which you believe should have the power to decide, the states and their voters, or the federal government for all the states. It is obviously more nuanced and deeper then this forum would allow to present, but it does come down to states or federal.
