After reading more than the initial hit-pieces the media put out earlier yesterday, knowing the area in which this happened, and having many years of accident investigations behind me, it's totally believable to me this was a misunderstanding. Ticket him and send him on his way. His insurance will take care of the rest.

Given that 1. No alcohol or drugs, 2. He thought the victim was uninjured and 3. His subsequent cooperation with police and statement commending police profrssionalism; 4) the character of this MOH recipient, that it was most likely a misunderstanding. The only thing I might say is that he should have asked "Are you all right/do you need aid. (Again we don't know all the fact, perhaps he said somrhing, maybe even got a reply; we'll have to wait and see)
