When purchasing a Gun from an FFL dealer you MUST complete a Background Check. Period.

Repeat. When purchasing a Gun from an FFL dealer, you MUST complete a Background Check. That is NOT optional. This is a matter of Federal Law.

Background checks already exist.

Federal Law allows "Person to Person" Transfers (aka sales) providing that they meet all the requirements of an FFL transaction. Now what that means is, if you are prohibited from buying it from an FFL Dealer, you are prohibited from doing a "Person to Person" Transfer. In other words, you're already a criminal.

Person to Person transfers are for "friends & family" but also apply to the secondary market, or collectors. If I wanted to sell a weapon out of my personal collection, to another law abiding citizen, this is one method of doing so, without having to get neither the government nor a business involved. That's all. It's already regulated (see above).

The problem is that many people, and organizations demonize this calling it the "gun show loophole" which is not only inaccurate, it's disingenuous, because of course we support background checks because they already exist.

However... And I pause for effect... If you asked the follow on questions. What would the answers be?

1) Should a husband be allowed to buy a guy for his wife, as a gift?
2) Should a parent be allowed to buy a gun for an adult child, as a gift?
3) Should you be able to inherit weapons owned by family members?

CPT Ahmed Faried - Wanted to add this for additional research material now that I'm back at my home comp. You may also want to check the Lott papers, and the research on "Defensive Gun Usage" numbers within the US. The data is "enlightening" to say the least, especially when weighed against ANY call for additional regulation.

If we actually enforced the laws that are in place, Started putting people in jail, and actually executed the ones that have been on death row for 20, 30 years or more and actually had judges and lawyers that didn't get these people off every time they went to court, I think if we actually put more in the ground and enforced the law and the punishment it would be different. "well I just killed a guy with a gun, and they wont use the death penalty I can spend the rest of my life in prison, three hots and a cot. I'm good" mentality.

I think part of the problem with this issue is that there's a lot of ignorance about background checks. For example, I cannot tell you the number of times I've heard the argument that we need to close the 'gun show' loophole in the honest belief that anybody can walk into a gun show and just buy any gun you want, no questions asked. Moreover, most people don't seem to know the difference between a clip and a magazine, let alone an 'assault weapon' and a fully automatic weapon.
