Intriguing OP-Ed. Since Conservatives and Libertarians claim that the States should take more responsibility then any notion that citizens in each state supporting state level ballot initiatives to fix socio-political issues should be considered a win. Don't you think?

Interesting article. Thanks for sharing.

Maybe I missed it, but I didn't see anything in the article that speaks to the practice of using the courts to toss out laws resulting from ballot initiatives.

That part is mention in a often unread document, The US Constitution, where the SC is the arbiter of whether something is constitutional a or not, Most states have similar sections in their Constitutions. All laws have to meet Constitutional muster, whether from initiatives of from a legislature.
