In Michigan, the unauthorized practice of law is punished by contempt of court ($7500 fine, up to 93 days in jail). Other states handle it differently. In Texas, it is a Class A misdemeanor for the 1st offense ($4000, 1 year) and a 3d Degree felony for subsequent ones ($10000, 2-10 years).

10th Amendment of US Constitution is about separation of state and federal government powers. If a "lawyer" is not bar certified by the state, he/she could face charges including contempt of court
