During the third year of law school, I was challenged to argue an appellate case in mute court that involved suing the government. The judge (a sitting judge from the Maryland State Court of Appeals liked my case and sparred with me for about a half hour beyond the allotted time. In the end I lost, but I convinced myself, if no one else, that shielding the government from liability serves no good purpose. Yes, the ultimate pain of paying damages falls on taxpayers rather than the negligent party. However, maybe taxpayers need to feel the pain. Maybe then they'll begin to think longer and harder about the representatives they elect. Maybe then government employees (including service members) will be scrutinized more closely. Maybe, just maybe...

CPT Jack Durish Sighs! Good article but tragic. Fere needs some serious reconsideration. It is heartbreaking and it amazes me that service members and VETS alike have nothing to show for it. Just bad memories and the sense that doctors can do whatever they want.

We should be able to sue the FEDS. It might get them off their "high horses"
