Perhaps. But the moral question revolves around what Col. Morris Davis said: “I just find it hard to believe though we do a deal for someone like Khalid Sheikh Mohammed who is responsible for 3,000 deaths,” My question is: "Should he be spared for the sake of money - for anyone?"
The legal question is: Is their case so uncertain they need to resort to this extreme to meet the burden of proof and convince the court?
The final question is would anyone believe him?

Thank you, Sir. My initial response was visceral. Hell no! Then, I thought about it and decided that if it's in the best interest of a greater good, then so be it. I feel that KSM and his colleagues should have been tried by Constitutional military commission, and then executed when found guilty. We did it to six of eight dry-foot German saboteurs in 1942, after two of the eight flipped on the other two. In less than eight weeks from capture, the six were electrocuted to death. They hadn't hurt a fly nor destroyed any property, but were found to have had the means and intent to do so. They were denied habeas corpus, tried by military commission under the Laws of War. Spies. All unlawful combatant detainees should have faced the same adjudication.

MAJ Montgomery Granger - A great point! However we do live in a more liberal atmosphere than even 50 years ago and to our detriment I might add.
The previous administration did serious damage to our security by undermining our laws with president setting directives and initiatives intended to do precisely that. It will take decades to undo the damage if in fact it can ever be undone.
I'd have to give a lot of thought to this before agreeing to trading with him.
