Yes, California is that insane. With minimal evidence, any criminal can be "excused" almost any crime because they have some sort of mental issue. No, we're not talking about the old test of "can the defendant discern right and wrong?" This reminds me of the time I was posted at Tripler Army Medical Center in Hawaii and the Chief of the Neuro-Psychiatric Ward convinced the commanding general that all perpetrators were merely misguided and he could straighten them out. The CG thereupon directed that all persons charged with Courts Martial offenses must be sent to the NP Ward for evaluation where, of course, they were given an excuse to skip trial and punishment. This worked until one day a medic was sent to the staff company CO for harassing burn victim from the USS Constellation explosion and fire off the coast of Vietnam. I was XO at the time and, in the CO's absence, began processing him for court martial. We called the NP Ward and asked to be notified as soon as the Chief there went to lunch. We then rushed the offender in for a quick evaluation by the staff doctor on duty and then sent him to the stockade at Schofield Barracks to await trial. The NP Chief never got wind of it until it was too late. Interestingly, behavior of all troops serving at TAMC improved immediately.
