He wasn't given UCMJ, he was tried in Connecticut at a US District a court. He should have been tried UCMJ, his complaint is that they did this specifically to take year from the Clinton scandal.

Top for some odd reason when I had my TS/SCI there was this section where you were briefed on what you can/can not do in a SCIF. You even sign that you acknowledge the training and the repercussions of a mistake. Taking photos, cell phones, USB type devices and anything that could broadcast or receive a signal was forbidden. This man had the same clearance as I did, had to have gone through the same briefing I did, and signed everything I did. He was even the same rank as me, so this whole ‘kid’ BS goes right out the door. Claiming it’s a ‘minor’ offense is BS being I’ve seen less loose their clearance and MOS. ‘Take responsibility for your actions’...standard leadership principle. I’ve fucked up ROYALLY in my career and NEVER said ‘cuz so-n-so did it and got away with it I should too’. I damn sure thought it a few times, but when I answer to the man, it’s ME SSG Swan answering for my fuck up. Not SSG Swan trying to deflect the punishment I got onto GEN Patreus, or even equate what I did to what he did. I fuck up, I own it, take my beating and move the hell on. Apparently this ex-sailor didn’t get the leadership memo.
