18 U.S.C. § 4: Misprision of felony
Whoever, having knowledge of the actual commission of a felony cognizable by a court of the United States, conceals and does not as soon as possible make known the same to some judge or other person in civil or military authority under the United States, shall be fined under this title or imprisoned not more than three years, or both.

The Federal misprision of felony statute is usually only used in prosecutions against defendants who have a special duty to report a crime, such as a government official.

Conspiracy to do War Crimes by Congress members

WHEREAS US House Speaker Nancy Pelosi (D-Calif.), Rep. Jane Harman (D-Calif.) and Sens. Bob Graham (D-Fla.), Sen. John D. Rockefeller IV (D-W.Va.), Rep. Porter J. Goss (R-Fla.) and Sen. Pat Roberts (R-Kan) were briefed from 2002 to 2003 in about 30 private briefings, about the planned use of cruel, unusual and inhuman treatment, to include water-boarding, by former President George W. Bush and his subordinates,


WHEREAS these Congress people had a Constitutional and legal duty to go public about the planned or on-going use of torture, ghost prisoners, secret jails, and kidnapping and rendition to proxy nations that torture, (all war crimes), notwithstanding that these activities were classified by Bush Administration. The memo described ten techniques which the interrogators wanted to use: "(1) attention grasp, (2) walling, (3) facial hold, (4) facial slap (insult slap), (5) cramped confinement, (6) wall standing, (7) stress positions, (8) sleep deprivation, (9) insects placed in a confinement box, and (10) the waterboard."[

WHEREAS a crime against peace, in international law, refers to "planning, preparation, initiation, or waging of wars of aggression, or a war in violation of international treaties, agreements or assurances, or participation in a common plan or conspiracy for the accomplishment of any of the foregoing" It is the supreme international crime differing only from other war crimes in that it contains within itself the accumulated evil of the whole.

THEREFORE BE IT RESOLVED we demand the US Justice Department prosecute these Congress people for conspiracy to do war crimes.


BE IT RESOLVED that the Authorization for Use of Military Force and related sections 1021 and 1022 of Subtitle D, (counter-terrorism), of the 2012 NDAA be repealed.

And damn right Kissinger is a war criminal.
Why didn't the US Supreme Court tell Congress and Bush that "war" is only against a nation's incumbent government's military and therefore, the invasion of Afghanistan and follow-on nation building were un- Constitutional.
The Italian appeals court, in Milan, sentenced Italy’s former head of intelligence, Niccolò Pollari, to ten years and his former deputy Marco Mancini to nine years for their role in aiding the CIA to kidnap of the cleric, Hassan Mustafa Osama Nasr. Osama Nasr was flown to Egypt where he was tortured. Three additional Italian counter intelligence officials were also sentenced to six years each. Despite being convicted of no crime (other than criticizing US aggression), Osama Nasr was imprisoned in Egypt without charges for four years until a Cairo court found his detention unfounded and ordered him released.
The former Rome CIA chief of station Jeffrey Castelli was sentence by the Italian justice system to seven years in prison and Italy's highest court that upheld the convictions of the 23 CIA officers.

Our US Justice system looks the other way at this crime.

I'd say go for it. One way or another his testimony would put an end to all the conjecture and posturing involving Russia. Give him immunity and be prepared to move forward based on what he says.
