Yeah. Remove the lawyers from the war room and send them to the front lines. I think that would solve a lot of problems, don't you? (Let the lawyer jokes begin...)

Also all journalists out of the country for 2 weeks to a month. War will be over. Nobody ask any questions and all the dead men will tell no tells.

Discriminating between terrorism and insurgency from a legal perspective does little good when staring down the barrel of a gun and does little in addressing the real problem - Pakistan has and is supporting the Taliban. Osama bin Laden's compound in Abbottabad and Akhtar Mohammad Mansour's home in Quetta are not subtle details - they are key indicators that our allies in Pakistan have political motives not aligned with ours. Calling the Taliban insurgents instead of terrorists and thus formulating legal parameters in dealing with them has been brought about by a serious disconnect in the realities of the war in A'Stan. This reality that has been ignored or improperly accounted for in our foreign policy for many years. As a result its manifesting in the legal indifference between the ROE's of Iraq and A'Stan. Maybe instead of playing semantics with the Taliban we should be more concerned with how we define Pakistan's role in this conflict. I'd be curious just how the legal suits would define an ally that supports an insurgency that is killing allied forces via terrorism.

I concur with Gen Campbell assessment that the major issue is the cognitive dissonance of the Obama administration’s war strategy in Afghanistan SFC Joe S. Davis Jr., MSM, DSL.
There is nothing wrong with attorneys who are well grounded being part of the plan development process and the operational reporting process. The commands JAG is an ally.
The POTUS Obama administration "strategists" and "legal eagles" do more harm than good as they seem clueless that they are developing an inconsistent foreign policy which diverges from reality too much of the time.
