IN THE UNITED STATES COURT OF APPEALS FOR VETERANS CLAIMS
ARGUMENT
A. The VA’s Delays Have Substantial Consequences For Veterans.
1. Veterans experience financial hardship, homelessness, threats to safety, and increased health problems while they wait long periods for appeals to resolve their entitlement to disability benefits........
He followed through on VA-assisted housing opportunities, moved into an apartment, and reported briefly being able to spend time caring for his father, a Vietnam veteran, before his father passed away. Grave errors during the VA examination to rate A.H.’s disability added to 13. the delay and distress A.H. endured. At the time the BVA granted A.H. service connection, VA treatment records in his claims file documented years of his paranoid and delusional thinking, chronic suicidal thoughts and prior suicide attempts, and chronically low functioning. Inexplicably, without conducting an examination, and without considering or referencing this clinical history, the VA assigned A.H. a 0% disability rating in August 2016. The result was crushing for A.H., and unlawful.
(National Veteran Legal Teams asked me to sign off when they found out about my case, and entered it into this case. A few years later my life develops more. Threats to Safety, Increased Health Problems caused by abuse from landlords when you are awaiting va support after denial after denail are my case in a nut shell.) What you just read above was me Aaron Hassay A.H. Denied va support for even a homeless housing voucher by the va who used my reserve enlistment against me in every denial. Of course they can say that that is not their fault, that is how the laws are written. I just go back to the Preamble of the Constition which states amazing statements of “We The People”. I do not think the laws as written or interpreted in this situation rise to the level of “We The People” the Preamble as written in The Constitution of which we all Swore an Oath to Defend. Laws are made to be interpreted with justice in mind.)
The talk of MST. I experienced a form of MST and ran on the ship when the guy my supposed friend confronted me on the ship in berthing for some sex, when we were both like 20 really no joke and I ran. Like a chicken in hell. I was engaged to a girl. THe ship the older guys calmed me down from the screaming and well basically made sure I was alive and carry on. But I never forgot the confusion and embarresment and the feeling of trust. I was. A reserve on their active duty ship. The trust. Regardless there are more horrific MST stories. But that is mine. Not so horrific. But what about CST Civilian Sexual Trauma after you are so beaten down in civilian life you are numb, and a landlord with a home can well do what??
Every day somehow someway I am reminded of and have to find a way to not end these thoughts of being a virtual trapped sex slave, scared to be homeless again, to a guy an older Navy Veteran himself, who was housing me, taking half of my social security disability income, threatening to kick me out at the same time, while I had a blown out back, my central nervious system on fire, and crying in bed alone, wondering how I had gotten to this point just 38.
I was being denied for 5 years by the VA Oakland strickly on the case I had a RESERVE ENLISTMENT. The worst thing in the world seemingly that you find out only after the fact, after 8 years of an honorable discharge. 5 Years assigned to a guided missle frigate part time with a reserve enlistment, deployed at times, thrown into the fire like throwing a young guy right into the middle of a NFL Football game, having to run plays, as a team, when you are out there much as a team, and have to get lit up, like you are having to digest 1 million flash cards in 5 minutes. Because you are in the reserve you can be put on duty, from a cold start, hot, endlessly, consecutively, operational and never be a veteran for veteran purposes, denied benefits while you blank out wonder what life is about being sexually abused harrased by your and landlord an older Navy Guy who sees a easy target who can not run. He was active duty. We both served on ships. But I could not access the va for nothing but a humanitarian waiver for a short time, where someone recently counted I had made over 20 remarks to different VA doctors, who made different inputs in the system I was experiencing sexual abuse exploitation in various ways and terms, and also in patient records on SSDI Federally Labeled for psych disability, not yet service connected, otherwise denied all benefits of a veteran because of this enlistment package.
One should know psych disability on ssdi terms is much harder definition then service connection for psych at the Va. SSDI is only 0 or 100. 100 would give you 900 a month approximately to live and eat monthly. VA psych connection can be 0 10 20 30 up to 100 percent. I know some guys who have a 90% rating working full time and have some pensions in government work and can not access SSDI for psych as they are working. I know one guy who has 100% VA rating and multiple government pensions from working full time. I had a near 10 year lapse in no SSDI or VA designation, while I fought in the street confused.
I think people should experience this if they have a question of it is ok or not,
How can you have an honorable discharge with an reserve package assigned to a FFG, and be denied by the va, while you are being sexually assaulted by a perverted guy who wanted you to move in to help him fix his house what was run down.
I told a Girl i had a possible interest in about this after the fact and she basically turned on me instantly
If a kid can be molested by his father or mother etc then this can happen. But as an adult you are deemed able to defend yourself, even when you are unaware of what is going on, and the legal nature of such, like landlord stuff.
In 1998 my navy army transfer off the ffg was denied for psych at MEPS and Spine Muscusloskeletal. But the records were never transferred bac to the ship so I missed out on all medical care attention or any review of in service disability. I was just put back on the same ship, same duty. I was falling apart in broad day light. You have no wonder why people can have their necks stepped on in broad day light and no one would step in to stop it, even while people are filming it all around.
So basically there are many things that are happening and seemingly others just want to not feel they can do anything to stop it and fight for justice.
I talk about this because well I hope it is my journey to talk.
I stand up for all those that would follow up on orders honorably and have a problem getting their life in the regular world up and running and the protection we need
