Gotta love his technical argument as a "violation of the 5th Amendment." Basically, he states, "Yeah, I downloaded kiddie porn -- got me -- and I distributed it. But since it was the SAME kiddie porn that I downloaded and then distributed, it shouldn't have been an additional offense."

As you say, douchebag. Hope he enjoys the next three years.

Not sure how the arguement was advanced. Distributing has a whole other element in the crime, the distributing... So in my mind, treating it as a separate offense is proper. Would be interested in reading the briefs and opinion.
