SPC Diana D. It seems as though you are only picking up part of the story on this individual. This has been going on for over a year since he was released from prison. Since the liberal left and illegal immigration apologist are making him and others like him their cause celebre, they are deliberately leaving out significant facts. I will start with the first fact and then continue:
1. Served approximately 3 years without completing his enlistment for cause (appears to have been chaptered out for drug abuse, specifically marijuana).
2. Received a less than honorable discharge upon exit from the service.
3. Approximately 4 years after ETS arrested, charged, and convicted (plea bargain) for felony drug possession and distribution (approximately 2 pounds of cocaine) by selling to an undercover agent.
4. Served 6-7 years of a 15 year sentence.
And those are the hard facts. Now for the soft facts:
1. First marriage ended in divorce.
2. Second child born out of wedlock.
3. Both the ex-wife and the mother of his second child are US Citizens.
4. No where in any of the stories has it been told whether he has married the mother of his second child, or if he is married to another woman. The story implies that he is married but does not actually say so.
5. He is also a poser or a purveyor of stolen valor, where he has claimed to have been special forces. From what I can discern and know - I know of no Artilleryman or someone that would have been assigned to an Artillery unit as an enlisted person being attached to an SF combat mission. (The SF qualified soldiers are well qualified to provide their own basic fire support and call for fire and in addition normally have an AF combat controller of some type attached for major missions.) And on top of that he did not even finish his enlistment?

SSG Robert Webster You are correct. The story I read did not mention that he had been chaptered out or that he had a less than honorable discharge. Thank you for clearing up the misinformation.

The part of the story I find really hard to believe is where he said the first he heard he was not a U.S. Citizen was after he got busted for drugs. Get serious, they go over all that stuff each time you deploy and furthermore folks in his unit would have seen he was Mexican and asked if he was a citizen or held a green card. So unless the Army has changed so much that nobody really cares about the Soldier next to them........have my doubts on that part of his story.

SPC Erich Guenther He actually was a green card holder and I thought they could not enlist in the military but I was wrong. You can join the Army if you are a green card holder and it is suppose to fast track you to citizenship.

SPC Diana D. - He was not an illegal or what some would call a 'Dreamer.' The article clouds the fact by stating that he came to the US as an 8 year old child. It also is misleading in that he came legally to the US, as did his parents and siblings. His parents and at least one sibling became naturalized citizens, while he did not. And that line about he believed that he was a citizen because he joined the military is an outright lie AND he knew and knows differently (in that way, he is also a fraud). That is the problem with these 'do good, feel good' stories, they are a bunch of fabrications designed to tug at a normal individuals emotions. And I for one am sick and tired of them and the people that believe or support their BS.

SSG Robert Webster - I remember the EDRE pre-mob exercises with the 101st they would go over your entire file, insurance, take your death picture, etc. No way would they forget to cover citizenship. It comes up in Power of Attorney, Insurance, etc. So for the article to say or imply this guy to say he thought it was automatic is BS.

SPC Erich Guenther - I definitely agree. In some cases if you were not a US Citizen or National you were not allowed to deploy on certain missions because they required/require a diplomatic passport. In other cases, some could not deploy or would not be allowed to deploy if it was to their home country due to 'government obligations,' i.e. subject to the country's draft or other. In some cases an individual was not allowed to re-enlist if they had not applied for Naturalization. So yes, his excuse is BS.

It wrong if he fought for this country he should be able to stay here and if he breaks law again he goes back to jail not to another country. SPC Diana D. thanks for sharing
