When confronted with vague laws, it is probably in the best interests of the people to side with the defendant over the government.

It doesn't matter what I believe, it's the way it is. I, and I imagine a lot of people, think it's messed up that someone can break in my house and steal my stuff, and then my tax money pays for their defense. That aside, in this case we don't even know if they guy had representation in the original cases. He plead guilty, which could have been that's what his lawyer (public defender or not) advised him to do or he didn't have a lawyer and he didn't know the full ramifications of a guilty plea. If he did have a lawyer (again, public defender or not), he did him no favors by allowing him to plead guilty, which could result in a deportation. Typically, we think of immigration lawyers as helping those with immigration issues and becoming citizens and how to get their family member here and things such as that, but also I would hope they would be versed in the consequences certain criminal acts can have on someone's status whether they are legal or not.
