State Criminal Statutes on HIV Transmission

Is knowingly having unprotected sex while infected with HIV a crime? Yes.
Article 128 of the UCMJ covers this. Article 128 covers prosecution under the statute which determines if bodily harm is likely to occur as a consequence of unprotected sexual activity by someone with HIV. Courts have determined that bodily harm is likely HIV transmission to occur therefore prosecution for an aggravated assault involving HIV transmission can and does apply under this statute. States have enacted laws making knowingly transmitting or putting your partner at risk for AIDS without informing them a crime.
