If you receive treatment, or a delay in treatment, or medical staffmisdiagnosed a condition that has worsened substantially, there are options to consider if you are a veteran-not active duty.
Depending on the employment status of the staff member, you may be able to file a claim against the VA
. If the staff member is contracted by the VAMC, then such contractor be sued directly by state or federal courts. A employee of the VA Medical Center cannot be sued individually, but rather can sue the Federal Government...under the FTCA(Federal Tort Claims Act)...If you have any questions ask away.
