Capt Gregory Prickett My point is the Border authorities made a mistake, shortly after being transferred to ICE, things got cleared up quickly.

MCPO Roger Collins - The kid was held for a month. That's not acceptable.

Capt Gregory Prickett Two points. 1. Don’t cross the border either way in the company of illegals, family or not. That’s why they over reacted and this mess happens when your overwhelmed by numbers. 2. Should benefit some ambulance chasing attorney along with his illegals family.

MCPO Roger Collins - Two points. Point 1. The teen never crossed the border. Point 2. Don't be Hispanic.

From the story:

The teen’s mother, Sanjuana Galicia, is an undocumented immigrant. Galan said that agents may have suspected the teen's documents were fraudulent based on previous documents his mother took out in his name. When the teen was still a minor, his mother took out a U.S. tourist visa in his name, falsely saying on the document that her son was born in Mexico, thinking it would make it easier for him to travel there to visit family, she said.

His mother also said that when her son was born, she gave him a different name, the Washington Post reported. She was never able to get her son a U.S. passport because the name on his birth certificate did not match other documents, she said.

It appears his mother may have made incorrect documents for her son which likely came up when the searched for him in their systems. If you present a set of documents and have conflicting documents on file (Visa's, Passports etc) you will likely get stopped and held until they figure out who you are and which documents are correct.

This is much ado about nothing. Had his mother not filed incorrect documents for him this would have likely never happened. Root cause, make sure you file documents correctly with the government or else.

And after being presented with the correct documents, they still held him.

Regardless, he is a United States citizen who was held without due process and without being able to communicate to the outside, including his attorney.

Capt Gregory Prickett - He also had documents likely in their database that conflicted with the ones he had. Documents on your person that conflict with a US Passport or Visa in the system is a red flag. That is what we like to call "suspicious". That is why he was held.

You could argue it took too long to figure out, perhaps if we were not dealing with tens of thousands of illegal crossing per month they could have focused more quickly on this.

He was not known to be a US citizen due to the conflicting data/info and being located near the border with those conflicts. Once that was figured out, he was released. This is his mothers fault for the incorrect things she has done and not rectified.

Cpl Jeff N. - no, he was not released once it was figured out. He was still held for days.

Did ICE hold him for three weeks or did the CBP hold him for three weeks?

SGT (Join to see) - Actually, a DL is proof of citizenship under the REAL ID act passed by the feds years ago. If you look on your TX DL, you'll see a gold circle with a white star in the upper right corner of the DL. That means that citizenship was verified prior to issuance of the DL.

Capt Gregory Prickett - In Texas you are correct. They require proof of citizenship or permanent residency. So in this particular case, that guy should have been detained for only a few minutes. In some other states, like California, they hand out drivers license like candy to anyone.
