I think he should use the "SGT Pepper/Michael Jackson" defense and say he was imitating a rock star, not a marine.

But there was a disturbing element to this story. If NY has a law against simply wearing a uniform or displaying rank, why didn't the police arrest him on the spot? The disturbing part is that it says the police raided his house. Really, raided his house over this? As in guns drawn, ready to shoot? If so, that's absurd in my opinion. And that's how citizens or police get hurt over minor charges.
