Maj Marty Hogan - I do with the CO and XO but not with the OOD. I have been in their position, trained them and seen what JOs at the end of their commitment who decided "I hate the Navy" act. She purposely violated standing order, good seamanship and those acts directly resulted in the death of 7 shipmates.

LCDR (Join to see) Maj Marty Hogan I am not sure about how a Court Martial looks at charges or how they are charged, I don't have experience in that, but when I was the County Sheriff, in my county not all homicides were crimes. All Homicides include the killing of humans, but there are different levels of homicide. Some criminal some not. The criminal ones have different degrees as well as the non criminal types of homicide.

CWO3 Dennis M. - This will be charged as Negligent Homicide which will carry prison time if convicted. I think the CO and XOs will be found not gusty on that but guilty on the lesser charges. But, my SWO bones pray to King Neptune that the OOD of the Fighting Fitz is found guilty and sees the inside of a prison cell.

LCDR (Join to see) - I agree and this SWO feels the same way, and I think King Neptune has his hands full hearing all the prayers and already has a special brig all ready for that OOD!

"The Burden Of Command" is a Navy-only lifestyle where the commanding officer is wholly responsible for everything on the ship. The purpose of the situation is to emphasize both to observers and crew, that the commanding officer of a US Navy ship has unlimited legal power unseen in a lot of organizations. The end result is that "only those truly committed" become "Captains."

Now... Here's where I deviate...

Being relieved for a collision that occurs while you're asleep is one thing. Murder charges for crew that died while you're off-watch? Hmmmm... Not sure (1) that this will fix anything or (2) send the right signal. What would Captain Don Murphy tell the president? "F**k you, I reject your commission. Find someone else to command the ship." If the OOD was fully trained and passed his exams (ATTENDED BY THE SQUADRON COMMANDER... :-0 ) then why should I face jail/death penalty because he screws up while I'm asleep?

So I'm gonna say "no" for now.
