Sounds like the system is working just fine for the private prison companies that make money of detainees. Now the taxpayer gets to pay about $200 a day for the next six months just to house and feed him while lawyers charge the taxpayers thousands of dollars to handle his case. Perhaps instead of being jerks and charging taxpayers tens of thousands of dollars, they could just slap a $100 a day fine on the man until he exits the country and he can't return until the fine is fully paid. At 60 days he will have 6K a fines and he should be rewarded with a free one way ticket to his home country.

First, we save the roughly $200 a day paid to CAA or one of its competitors. Then we get the $100 a day fine when the gentleman returns to the US, or he chooses to never return. Either way the taxpayer winds up way ahead, and if the Australian decides to return he will likely take extra care to ensure he satisfies all his requirements a few days in advance.
