Secession by an area of any state from the state itself is unconstitutional without the approval of the mother state so the creation of West Virginia was allowed by the SCOTUS in a ruling due to Virginia's unconstitutional beginning act.

Thanks for reminding us TSgt Joe C. that on June 20, 1863 West Virginia was admitted into the Union as the 35th U.S. state, or the 24th state if the secession of the 11 Southern states were taken into account. The same day, Arthur Boreman was inaugurated as West Virginia’s first state governor.
