Needing advice. I’m reserves, been in 6 years now. I opened a department of labor case on my company for harassment after locking me out of work after drill weekends and refusing me time off because of “excessive absences” (only days I take off are drill.) they have locked me out for about 30 days with no pay.

My company wants to get me to dismiss the claim, basically retract my statements and what they can give or do for me to do that. My rep said it sounds like they know they are guilty.

I have a new job in line I’m just waiting to start. If I dismiss and make my demands, it won’t go to the AG, if I deny, I will have my case referred to the AG.

What should I demand if I decide to close the claim? My family is saying to request a lot of money but I’m not sure at this point. (Demands have to be within USERRA guidelines)

I'd let it to to the AG and see where the process takes you. (That's a personal opinion and not legal advice.)

Save all evidence to include emails. Keep a journal. The bitter pill is you will have to pay an attorney up front to take your case.
