What is regulation as far a serious injuries and APFT failures go?

Regarding record APFT. If you fail a pt test and shortly after get in a massive car accident breaking your pelvis,sanctum, and fibula. You have been on temporary profile for let’s say almost a year. the medical provide keeps renewing a temparary profile instead of moving to p2 profile. And Your 1sg things you are avoiding APFT. You get scared of chapter threat and decide to try and take APFT since the unit doesn’t not allow alternate events unless you have a permanent profile. You take a APFT pass PU and SU but you fail the run. And now you have failed 2 consecutive record APFT and are being chaptered for pt failure. The 2 record APFT are exactly 12 months apart is this a legal chapter?

1. You shouldn't have taken the second test.
2. All questions regarding the validity of a profile can be directed towards the provider that is issuing the profile.
3. If memory serves, no Temp. profiles, that is army wide, can take alternate events in APFT.
4. Not to be a downer, but due to your ignorance of the system, you may have screwed yourself into getting chaptered. Your NCOs failed you in that they didn't "protect" you from this kind of bull.
5. You may be able to speak with JAG about all of these circumstances. When getting chaptered (or when the command informs you that you are getting chaptered rather) it is your right to fight against the chapter. You can speak with JAG about it and see what they think. I would go ahead and get together a copy of your medical records from your Primary Care Provider and have those on hand to show JAG.

2. Actually with the new profile system you can take an APFT on a temporary profile if your provider approves it. There is also no more recovery time - it's written into the profile. The provider writes down when they recommend the soldier can take an APFT.

SFC (Join to see) is correct. As a provider, however, I generally wouldn't approve an alternate event for an event that someone has previously failed. If you suck at running I'm not going to let you do an alternate just so you won't have to run anymore. This Soldier's situation is different though because he had a pretty traumatic injury that would definitely affect his ability to run.

My concern is your first sergeant may be jeopardizing you and you could be getting re-injured just trying to take the APFT. Why I get permanently injured? I realize you want to do the right thing. Thank goodness for rallypoint because you were really injured in that car accident. Let's wait for some more answers but I hope you have all your medical records available that you can take to an independent provider like the VA were the Army won't dispute it.

In my opinion, I think you should go to the VA and get an opinion. I broke my fibula while in Afghanistan in combatives and it took four months to be considered return to duty. You have much worse injuries than this. It's possible they may want to medically board you out of the guard or Reserve. I don't know what the regulation on this would be. Let me see if I can get some help here on Rally Point.

LTC (Join to see) respectfully, going to the VA might not be the best idea, as they’d probably turn him away.
See the link below from the VA pertaining to treatment of active duty. The most applicable portion would appear to be:
“Routine Care
VA will only provide routine care to Active Duty Servicemembers with a valid TRICARE referral or authorization.”
Unless the Army sends him there, they won’t see him just to give him a second medical opinion.
PFC (Join to see) - make sure you copies of all your records. The Army might conveniently misplace them. It might cost a few dollars, but go see a civilian doctor and get his opinion. And get prepared for some sort of separation. Talk with your Army doc. You might not want it, but after breaking half your body, and you’re not back to 100%, you need to be ready for any outcome.
