First of all he isn't going against the constitution and nowhere in the article does it mention anything about the bible so how is he going against that? His tweet that says people here legally have been waiting on citizenship for years have done it right...and it isn't right to put illegals ahead of those working the legal process!
Second...how can the ACLU say they aren't getting due process? They aren't citizens...they are here ILLEGALLY and therfore do not fall under the protections of due process...this is not illegal and unconstitutional IMHO.

what about the illegals he employs,he's a contradictory buffoon. Besides due process applies to all persons not just U.S. citizens. Thank goodness for the Constitution, which requires due process. The Constitution and our laws are the only thing standing between Trump and deprivations of our rights, which is why he tries to undermine the judiciary at every turn. He also used the term invaders. The only invaders are those that slaughtered the Natives and " found the Country"

GySgt John Olson - Since my original post I have done more research and through Capt Pricketts response understand the law a little better. "[O]nce an alien enters the country, the legal circumstance changes, for the Due Process Clause applies to all "persons" within the United States, including aliens, whether their presence here is lawful, unlawful, temporary, or permanent." Zadvydas v. Davis, 533 U.S. 678, 693 (2001). Therefore, if we turn them around at the border not letting them cross or put up the wall and can't cross then they have no protections since they aren't even in the country. I know that is a simple concept but if they aren't on our soil then we don't have to give them the protections and due process. Again, I am not against people coming to America...just come legally...long process but if they are determined some can make it work.

Bullshit. There is nothing in the Constitution or federal law that says illegals are entitled to a court hearing before being deported. Right now, only approximately 15% of illegals get a hearing before being deported. We are a country of laws, so the Bible isn't relevant.

1stSgt Nelson Kerr - I didn't just pull those two cases out of my ass, and I'm not imagining anything. Those two cases are what legal scholars consider the basis for decades of SCOTUS holding that deportation is an administrative process. So if you want to argue that those cases don't say that, then argue with SCOTUS.

I never said Due Process doesn't apply. I think the problem here is that you're confused on what Due Process is. Due process is the legal requirement that the state must respect all legal rights that are owed to a person. Some rights that apply to criminal proceedings do not apply to administrative proceeding, and SCOTUS says deportation is an administrative proceeding.

Cpl Mark McMiller - what part of either decision is relevant to due process at all? I do understand that deportation is a civil proceeding but it is not one of the places where due process has been cut out of the system. At least cut out by congress or the courts, and they are the only ones that can do so.

What legal scholars? Do you have a source for those "Legal Scholars" and do they have names?
