CJ Grisham, President of Open Carry Texas, Army veteran and recent candidate for State Representative in District 55, along with a couple of other people was arrested yesterday in Olmos Park, TX (Bexar County). He was tazed and subsequently injured in that arrest with a head injury and was hospitalized. I was told that the head injury was a large gash on the back of the head. He also suffered numerous scrapes on his wrists and arms.

Grisham and crew were legally opening carrying pistols and long guns in response to an event last week when an Olmos Park police officer drew guns on and detained someone with a protest sign solely for the reason of open carrying a pistol (which turned out to be a training fake).

Grisham had a phone conversation with the Olmos Park Police Chief, Rene Valenciano about their policies, etc. in which the chief seemed entirely unconcerned with his officers illegally detaining people for a perfectly legal activity. (The conversation will be linked in the comments below).

Grisham and crew went to Olmos Park yesterday and were legally and peacefully open carrying and got arrested for it. There is a video of the arrest. There was no articulated probable cause for the arrest. The police showed up, including Chief Valenciano and ordered Grisham and his crew to the ground. Grisham at least refused. It was Valenciano that personally tazed and arrested Grisham.

Between the phone call and video from the site, it's very clear this was an illegal arrest by an oath breaking police officer and they will be held accountable.

It stuns me that a Texas police chief could be that incredibly stupid. I hope he loses his job and faces prosecution for this stunt.

You both have valid points. That said, my best Army buddy retired from Omaha PD as a SGT. He and I were discussing the police and how they view the 2nd Amendment. I had stated something like, "The police are our last like of defense to uphold the 2nd Amendment."
His response was that, today's larger departments mostly all require a college degree. He advised me that when he had to work as a training officer to tutor and mentor new officers, he was at first dumbfounded by their attitude that, "Civilians should NOT have guns." When he discussed it in detail with them, it became clear to him. The college educated officers, MOST of them, had been indoctrinated by liberal-minded professors.
He was convinced, and I am as well, that larger departments who require degrees are very likely to have many anti-gun minded officers. Something to think about.

PV2 Rooster Cogburn - Your viewpoint, while technically correct, isn't necessarily the logical thing to do. If I was stopped by the police, for anything, and they ordered me to the ground; ESEPCIALLY at gunpoint, you can believe that I'm going to the ground, lawful order or not. There are too many examples of tragedies; ESPECIALLY when anyone opts to ignore or disobey an officer's commands. My goal is always, "SURVIVE," and as the saying goes, "The key to survival is adaptation." So, I'll adapt and fight an illegal order later - in COURT.
All that said, it SOUNDS like the case triggering this discussion, was simply a man who initially refused to obey the officer. How? What was said? Why? It also sounds like the police chief really had NO patience and (obviously) no respect for the LAW. Was it right for the chief to taser the guy? No, I don't think so - not in the least. Was it wrong for the guy to disobey the chief? PROBABLY not; but look how it ended. Could've been far worse.

SSG C.V. Shaw - Sarge, I AGREE that you have that right. But, when you say, "I want everyone to know that I have one so that they are aware that I have a means to defend myself and others," there is something else to consider. WHY would you give up the TACTICAL ADVANTAGE?

SPC Chris Ison - I agree that racism needs to die - I also believe that racism is an absolute concept and ABSOLUTELY REFUTE the lies presented in the damnable "Critical Race Theory". Racism surely does exist today and never more evident than from the left and the BLM movement.

In essence, this was a constitutional audit that Olmos Park Police department failed to a level no one imagined. They went there to expose the corruption and constitutional violations of the Olmos Park Police department. All OPPD had to do was honor their oaths. Instead, the held armed and unarmed civilians at gunpoint, assaulted two people who were neither suspected of not committing crimes, destroyed evidence (broke camera of Jim Everard), seized and kept cell phones (because of the video that was taken on them), they tazed and assualted a man who was neither a threat nor a suspect, they kidnapped a woman on a retaliation warrant that they got for "interfering" for her videotaping them harrassing someone with a sign, then that same officer that had assaulted that lady prior got caught on tape threatening to rape her when she was in back of the police car, they falsified documents, filed false charges, lied, bragged about "squashing the rebel" because they knew who they had, held other camera operators at gunpoint, and the list goes on. Not sure why you're conflicted unless you believe in backing the blue no matter how corruption the officers are. If OPPD has egg on it's face, they put it there themselves.

SPC Chris Ison - When was that version of 10 U.S. Code § 246 - Militia: composition and classes written? Clue - the date of writing is 1956! Again you open your mouth and insert your foot. I am getting tired of addressing this with you! When you are referring to a document, you HAVE TO go by the definition of the word at the time that it was written! At the time that the 2nd Amendment was written, the term militia was meant as a separation from the Federal Government. The militia was meant to quell any attempts towards tyranny! The Founding Fathers wrote many documents, including letters, to explain just what they meant. 1) The National Guard was never meant nor will it ever be the militia that the Founding Fathers intended, and 2) The National Guard did not exist at the time of the writing, thereby meaning that the Founding Fathers NEVER intended a force like the National Guard to be the militia that they mentioned. Dude, you need to get tested for mental acuity! You are the dumbest person I have ever come across being that we are going around in circles due to your lack of understanding what a 5 year old can understand!

LEGAL definitions are defined by statute.

The constitution is like a cities general plan, and the USC is the same as the Zoning Code, it is the implementation of that plan.

SSG Jason Penn - I believe that section of the code was revisited and minor language changes made in the mid 90s. If I remember right it had to do with women in the organized militia (National Guard). Don't remember any changes to the unorganized militia (males between 17 1/2 and 47 if memory serves). You are right, the founders writings, including the Federalist Pares, make it very clear that their concern was with preventing tyrannical actions.

MSgt Donald Brookover MSG. You might want to check our Constitutation yet again. Taxpayers will and 99.9% of the time have footed the bill for police misconduct. Check the recent Supreme Court decision. We cant win when it comes to civilians with too much to hide get elected to office. Those who know of their indiscression will always profit, Im sorry to say.
