One of my peers in my unit is about to turn 60 in a year or two and was asking me if the Army would promote him or not. From our understanding of how it works in the Reserves is you have to hold the rank for 3 years to retire with it.

I told him I can see a few possibilities. 1) the Army wouldn't give him the promotion if he has to get out within 2 years. 2) the Army would say whatever, promote him and let him retire as a SFC. And 3) the Army would extend him an additional year if he chooses to except the promotion. I told him I'm not too knowledgeable on centralized promotions or reserve promotions but that I'd ask RP.

He will promote and retire as a SFC; however, his retirement base rate will be determined by his high 3 years. If I understand his situation correctly, he does not incur the 36-month service obligation upon promotion to SFC because he is eligible for retirement and over 60 years old. Check out AR 600-8-19 Enlisted Promotions and Reductions paragraph 4-8.

Right now I'm 60, if I go before the board I will be 61, and get out on my 62nd birthday. I'm told by several there's no possibility to be boarded. I'm working all avenues and approaches now to overcome the regs, and indulge the right folks.

I know early in my career I worked for a Major promoted to LTC within a short time period. For retirement it’s based on his 0-4 pay but his ID card says LTC /0-5. If your fellow Soldier gets selected and promoted accept the promotion. Regardless of the final retirement it points that count the most. I look forward to more knowledgeable Admin folks to respond

AR600-8-194–8. Service remaining requirement
a. Soldiers incur a 3-year (36-month) service obligation upon promotion to SFC, MSG, and SGM. The service remain- ing requirement begins on the effective date of promotion, unless Soldiers are in one of the following categories:
(1) Eligible for retirement based on retention control point (RCP) for the recommended grade. (2) Already eligible through prior service for a higher rank at time of retirement.
(3) Age 60 or older.

b. Soldiers not having sufficient time remaining in service must reenlist or extend to meet the obligated service, or decline promotion in accordance with paragraph 1–26c. If the pin-on is delayed for administrative reasons, the service remaining requirement will begin on the original date the Soldier would have been promoted.
(1) Soldiers must meet the service remaining requirement within 30 days (RA) or 60 days (USAR) of the announced promotion effective date or be subject to removal from the recommended list.
(2) If service remaining requirement is not met; orders will be revoked.
c. Soldiers selected for promotion will be promoted on the last day of the month before being placed on the retired list if their sequence number has not been reached and they are in one of the following categories:
(1) Will complete 30 years of AFS.
(2) *********Will have reached age 60**********.
(3) Will reach the RCP while on a promotion list.
d. CDRs will advise HRC (AHRC–PDV–PE) of these Soldiers in time to allow for preparation of promotion orders
before the Soldier retires.
e. A promoted Soldier may not, at his or her own request, be reduced to terminate the required service requirement.

I was informed today I was too old to be reviewed by the board. I'm 60 now and by the time the board sees my ERB ARB I will be 61. I'm told the new regulation is 57 years of age max, with three years remaining. I'm filling through the G1 and the Inspector general for guidance and a possible ETP. The regulations conflict each other repeatedly, the new regulation also states no waivers are allowed.

SSG(P) (Join to see) - Like many regulations there are blind spots as the authors couldn't think about ever issue. There is always an exception the problem is finding it and getting someone with the starch to sign it and defend it.

Final review this week from Pentagon on appeal for promotion. Not possible and denied based on my age and they will not do a records correction. I asked for a honorary promotion based on my service and completion of NCODP. They said flatly NO! I'm now being accepted to different posting with the California National Guard and will be promoted as of last month. The struggle continues...also still fighting to get my retirement pay after 10 months (retired in Jan) and still no pay.
