Before you get all het up either way - the headline and the initial paragraphs tell one story then the slant abruptly swaps in the other direction. Words is the station KOB4 finished watching the video and did an immediate about face.
Another case of nobody knows but hurry, hurry get something out there.

Then, a white man in a blue T-shirt appeared to rile the crowd, according to video obtained by KOB4. People erupted in shouts and the man took a few steps back. A masked protester swung a skateboard and struck him in the shoulder. The man back peddled out of the crowd, but continued to exchange shouts with protesters. Someone in the video encouraged people to follow the man and get his license plate number. Several people followed him, and one tackled him to the ground. As he tried to stand back up and three people tried to hit him again, the man in blue pulled a gun and fired four shots, striking one man and scattering the crowd."

One guy yelled "I'll kill you" or something to that effect. That's when the guy bailed out again and shot the skater boy. Some of the footage I've seen appear to show skater boy with a knife as well.

Seriously - Can they prove without a doubt it was concealed?
Also what other charges - I heard Terrorist Threatening - a technically that was automatically part and parcel under New Mexico Statutes so once the shooting charge was dropped due to (or any other reason) self defense it had to be dropped also.
New Mexico says for residents that open carry is fine. New Mexico is also a 'Shall Issue' state when it comes to concealed carry and the cost is only $100 + you must have firearms training. Of course no felonies.

The New Mexico concealed carry license is only required if you want to conceal a firearm on your person. It is legal to open carry a handgun without a license.

SFC Ralph E Kelley - I doubt that they can prove it, especially by the video, but I figure they'll throw everything at him and see what sticks.

The shooter had every right to defend himself. The videos being seen on youtube shows that the shooter may have did something that warranted a response, but the response that was given was over the top with death threats.
That said, one of the attackers had a knife and that too has been posted to social media. The shooter was justified in his response. It was clear he was attempting to get away. They not only chased him, but threatened his life. He didn't pull his weapon offensively, he pulled it only after he had been tackled and they still pursued him. The person that was shot was the same asshat holding the knife.
Edit: After carefully watching the video, he did have his weapon drawn before the shooting, but only shot the individual with the knife.

A dozen people were chasing him and shouting, "We'll kill yo!" - yeah I would have fired to but probably as soon as I saw the knife. All others that fled would have been safe. Those that attempted to advance, not so much.
The report said he "riled" them - sorry but they say that's not a reason to attack anyone.
My opinion is some individuals intended to start trouble.
