LTC (Join to see) So they are seizing weapons, ammunition, and any other weapons. Which seems to be a violation of the Constitution. From what I have found in a quick search, the U.S. Constitution still trumps any local laws, therefore this would be a violation of the constitution. It would definitely violate the second amendment, fourth amendment, and fourteenth amendment. Depending on how far this is pushed, it could end up violating the third as well (if they decide the National Guard Troops need a place to stay). The last one is a bit of a stretch based on the edict released.

PO3 Steven Sherrill I agree with you this is an unconstitutional order, and I am sure it will get worked out in the courts. Meanwhile NG troops are being ordered to seize arms and ammo...

An order they are obligated to disobey, it might be worth pointing out. Especially if any members of the USVI National Guard happen across this post.

If the NG troops of the Virgin Islands are so poorly armed, equipped, and supplied that they would have to confiscate weapons, explosives, etc. from private citizens then it should be considered proof that the government is outrageously incompetent, and should resign.
Of course, it is not likely that the NG has been so neglected. It is much more likely that an opportunity has been seized to confiscate weapons a la Katrina in New Orleans, only before the fact. Maybe they expect less resistance that way.

LCpl Arthur Forbes - It was obviously an "opportunity" the gun-grabber governor thought he could pull off. Now the question should be, "Do any in the chain of command in the NG want to keep their oaths to the Constitution, or kiss the a$$ of the governor and risk arrest for violation of federal law?"

Well...

I think I don't live in the Virgin Islands and that's something that they should take up in the courts.

The National Guard should ALREADY have "guns, ammunition, explosives, and property" needed to carry out whatever the National Guard needs to do.

If this happened in CONUS, wherever I may live, I would fight this tooth and nail and be quite willing to shovel money into the pocket of an attorney to battle this. But I'm NOT handing over my personal firearms and ammunition.

There is no call to confiscate ANY firearms from citizens UNLESS they're being arrested and charged with something. This is called "due process".
