NEWSWEEK conveniently leaves out of their disloyal tome the fact that the policy governing Military Commissions at the U.S. military detention facility at Guantanamo Bay, Cuba, comes from President Obama's 2009 Military Commissions Act, which gives unlawful combatant Islamists who want to kill us virtually the SAME rights you or I would enjoy in a US federal court of law. Gitmo is legal, or it would be closed. 730 detainees have been RELEASED, and NONE have been executed, beheaded, hacked to death, blown up, dragged naked and lifeless through the streets, drowned or burned alive, all things our enemies have done to us and/or our allies. Gitmo is a small but essential piece to the puzzle of how we win the Global War on Terror. All war crimes proceedings should be suspended until the end of hostilities, just like what happened after WWII with the Nuremburg Trials. In fact, the Geneva Conventions an Law of Land Warfare state that even lawful combatant POW's may be held without charge or trial until hostilities end. What's different about these unlawful combatant Islamists who want to kill us? Entities like NEWSWEEK sympathizing with them and promoting their attempt to influence a political end to their lawful incarceration through the use of lawfare. Sincerely, Montgomery J. So who exactly do you believe is authorized to sign the surrender document on behalf of our enemies in the GWOT that will officially signify the "end of hostilities" that you say is required before any trials take place? Do you really envision an end to hostilities ever? Do you see a day when there will be no extremists groups of any kind willing to take violent action against US interests or those of our allies? Do you believe there is some sort of terrorist government that speaks for all groups that use terror attacks as a tactic who can proclaim an end to hostility? Or is what you are really advocating is the lifetime incarceration without trial or legal process of any kind of anyone detained anywhere in the world in conjunction with any attack, with no requirement to ever present any actual evidence of the persons involvement in the crime, or with no regard to whether statements supposedly admitting guilt were obtained through torture? The USSR was pretty good at those techniques but back then the democracies chastised them for it. Do you believe that we no longer should uphold our previously held principles because now bad guys are somehow meaner or crueller than they were before?
