Some details- I’m in the N.C. national guard, we have a deployment date set for next September. My husband is currently in Oklahoma at new duty station. I’m not sure of the regulations regarding an IST. Provided all of my criteria are met for an IST, is the state still able to deny it?

Yes, the state can still deny it. Especially if your MOS is in need for the mission. If you want to dig further since you are not sure of the regulation, look in NGR 600-200
