back in November of 2019 I failed H/W after taking a PT test. They did not allow me to retape and immediately put me into the ABCP program days before I was supposed to be given rank.
I have now been in the program to present and they have not been regularly taping me since January. Nor documenting it properly. I passed my tape back in December of 2019 and they decided to keep the previous failed tape to keep me in the program. They then proceeded to bar me from reenlistment the following week.


It is now July and I am pregnant. Are they permitted to keep me in the program and flagged or do they have to move me to the pregnancy flag? I'm in the process of going to IG for their poor documentation and the inappropriate ways they have discussed my weight to others in my unit without my permission.

When you are pregnant and on the ABCP you stay flagged, there is no flag for being pregnant.

Your command team is 100% allowed to discuss your weight and no one in the whole entire world needs your permission to discuss your weight. Weight is not a protected category under EO and it is not only your leaderships business but their RESPONSIBILITY to address. The Army has a strong prejudice against weight.

If you had a passing tape your flag should have been removed. Of course, if you failed again after that then you should have been automatically separated. This is why some command teams will require a Soldier to be at least below the passing body fat percentage prior to removing the flag. Since you only mentioned one passing tape it's fair to assume the rest were failing. Your command actually protected you by keeping you flagged. By regulation you should have had your flag removed and then separated the very next failing tape, which can come at any time, not just during an APFT. COVID has not suspended the ABCP program.

Barring someone flagged is a waste of time and it's irrelevant to you. You can't reenlist while flagged. Once you get unflagged the bar comes off immediately. Being barred doesn't get you separated either.

You can go to IG but they're just going to open AR 600-9 and point out the reg to you. If your command hasn't properly documented your progress, that is in your favor because the separation packet requires proper tracking and counseling in order to separate the Soldier. I'd say that you've gotten very lucky in this situation
