I am expecting my second child in July. I opted out of a chapter 8 and had about 70 days left until my due date. Is it legal to be separated before I give birth? Where could I find answers? Not having one temporarily will not get you separated but if you fail to complete one you can be administratively separated. Da Form 4187 request the COC. But to answer your specific question yes you definitely be separated for no family care plan, I have personally seen this happen to single male parent Servicemember. The CoS and JCS has put out that if you can deploy then go home cause its a burden on the deployable troops. Regs are very specific- 0 Fanily care plan and you are gone. Damn well can't deploy with a child on your hip, and we can't wait a depl;oyment cause you aren't ready!. Plain and simple unless you have one, you are non-deployable and subject to dismissal.
