He is being chaptered with no appeal. Is there no ABCP for him, or FTU? Or is it just a chapter? No, there is nothing you can do about it for your Soldier. The APFT is an individual event and if they are unwilling to improve or maintain outside of PT hours, then that is their own fault. They will of course, not receive a dishonorable discharge, it's been a few years since I kicked someone out for APFT failure, but, I believe it is a General discharge. Different units have different programs. If your Commander has initiated the Chapter paperwork, there is not a lot you can do. It is POSSIBLE that you (and by you, I really mean your PSG and PL) can work a deal with the Commander to slow roll the paperwork, and give your Soldier one more chance to prove himself. If you can get him into shape before the Chapter paperwork is finalized, the Commander has the authority to stop the separation. But that is ENTIRELY at the Commander's discretion.

By reg, if the Soldier has failed 2 consecutive PT tests (and provided all of the other requirements have been met, like adequate time for recovery if a profile was involved, and adequate time between APFTs, just to name a couple), then the Commander is required to initiate separation. There is no appeal for that. However if the other requirements have NOT been met, then the Soldier should go see JAG. I have seen it done. And i have seen where the individual failed two of them puposely and he was not chaptered because he owed the US Army time for his schooling. He was flagged until he paid it back and then he was chaptered. Not will be. A lot of circumstances involved when it comes to a chapter procedure. I had a soldier who failed two pt tests. Being a medic I noticed something during the test that others didn't. In a nutshell, I referred him to a physical therapist who prescribed orthotic inserts for his shoes. after that no problem for the run. Honorable if no prior incidents like art15 and if your are in good standing with unit. other than honorable if otherwise. how fast it happens depends on unit, some guys sit around not passing one for longer than most contracts others get the boot faster than it took to put it on.
