But this information, when viewed with the blinders on, is a bit misleading. Like others have posted, these EOs are quite old and were signed at a time when nuclear war with Russia was not only possible, it was probable.<br /><br />Can the President still act on these EOs and seize control of these resources? Yep. Can a President abuse these powers and expect no consequences? I think not. We may have a divided Congress but I like to think they would unite in the face of a tyrant trying to wield powers that go beyond reason and purpose. They can also impose martial law and it's equivalents.<br /><br />Got your attention? It's actually the ability to deal with nuclear accidents. It depends who has custody of the asset. DoD and DoE are the primary owners but the law, procedure, and assets are in place to respond to a weapons incident.<br /><br />Oh, the third agency? NASA. They have RTGs for deep space flight in their custody. Drills are routinely conducted with DoE doing a major one every 5 years or so. The last one we had out Bangor way was a DoE asset being hit by terrorists near Bremerton. About 2000 people descended on the place, a virtual security area established, and the locals participating heavily. When you think of it, I'm glad stuff is pre-figured out. CAPT Kevin B. They are a necessary part of the executive process. However, Executive Orders must be backed by statutory and constitutional law. They cannot be used to enforce an executive whim which has no basis in the law. Sadly, this Executive, the one currently occupying the White House, is using Executive Orders to effect his whims. Are we surprised at this? We shouldn't be. He has spoken very clearly on the subject, lamenting the fact that the Constitution frequently stands in the way of his doing what "he knows" to be right and necessary.
