EXECUTIVE ORDER 10990 allows the government to take over all modes of transportation and control of highways and seaports.

EXECUTIVE ORDER 10995 allows the government to seize and control the communication media.

EXECUTIVE ORDER 10997allows the government to take over all electrical power, gas, petroleum, fuels and minerals.

EXECUTIVE ORDER 10998 allows the government to seize all means of transportation, including personal cars, trucks or vehicles of any kind and total control over all highways, seaports, and waterways.

EXECUTIVE ORDER 10999 allows the government to take over all food resources and farms.

EXECUTIVE ORDER 11000 allows the government to mobilize civilians into work brigades under government supervision.

EXECUTIVE ORDER 11001 allows the government to take over all health, education and welfare functions.

EXECUTIVE ORDER 11002 designates the Postmaster General to operate a national registration of all persons.

EXECUTIVE ORDER 11003 allows the government to take over all airports and aircraft, including commercial aircraft.

EXECUTIVE ORDER 11004 allows the Housing and Finance Authority to relocate communities, build new housing with public funds, designate areas to be abandoned, and establish new locations for populations.

EXECUTIVE ORDER 11005 allows the government to take over railroads, inland waterways and public storage facilities.

EXECUTIVE ORDER 11051 specifies the responsibility of the Office of Emergency Planning and gives authorization to put all Executive Orders into effect in times of increased international tensions and economic or financial crisis.

EXECUTIVE ORDER 11310grants authority to the Department of Justice to enforce the plans set out in Executive Orders, to institute industrial support, to establish judicial and legislative liaison, to control all aliens, to operate penal and correctional institutions, and to advise and assist the President.

EXECUTIVE ORDER 11049 assigns emergency preparedness function to federal departments and agencies, consolidating 21 operative Executive Orders issued over a fifteen year period.

EXECUTIVE ORDER 11921allows the Federal Emergency Preparedness Agency to develop plans to establish control over the mechanisms of production and distribution, of energy sources, wages, salaries, credit and the flow of money in U.S. financial institution in any undefined national emergency. It also provides that when a state of emergency is declared by the President, Congress cannot review the action for six months. The Federal Emergency Management Agency has broad powers in every aspect of the nation. General Frank Salzedo, chief of FEMA’s Civil Security Division stated in a 1983 conference that he saw FEMA’s role as a “new frontier in the protection of individual and governmental leaders from assassination, and of civil and military installations from sabotage and/or attack, as well as prevention of dissident groups from gaining access to U.S. opinion, or a global audience in times of crisis.”

These orders have been on the books for decades. Not sure what the problem is and if the Canadians or Mexico try to do a Red Dawn, it is what everyone already assumed would happen?

Those EOs are to be used in extreme national disasters or a nuclear weapon detonated in CONUS. They're basically null until a national disaster of extreme proportions.

I'm all for the sanctity of states and small federal government. But this information, when viewed with the blinders on, is a bit misleading. Like others have posted, these EOs are quite old and were signed at a time when nuclear war with Russia was not only possible, it was probable.

Can the President still act on these EOs and seize control of these resources? Yep. Can a President abuse these powers and expect no consequences? I think not. We may have a divided Congress but I like to think they would unite in the face of a tyrant trying to wield powers that go beyond reason and purpose.

An interesting wrinkle in the law, not Executive Orders, is the ability of 3 agencies to seize any real estate, public, state, or federal land. They can also impose martial law and it's equivalents.

Got your attention? It's actually the ability to deal with nuclear accidents. It depends who has custody of the asset. DoD and DoE are the primary owners but the law, procedure, and assets are in place to respond to a weapons incident.

Oh, the third agency? NASA. They have RTGs for deep space flight in their custody. Drills are routinely conducted with DoE doing a major one every 5 years or so. The last one we had out Bangor way was a DoE asset being hit by terrorists near Bremerton. About 2000 people descended on the place, a virtual security area established, and the locals participating heavily. When you think of it, I'm glad stuff is pre-figured out.

Homeland Security is the principal agency to protect the US from attacks internal and external, prepare for disasters and relief. All the Agencies and Cabinets will fall under Homeland Security's umbrella to include a 3 and 4 stars to coordinate the military response. Sometimes the government needs broad powers in time of suffering and need.

In a great disaster the government will contract planes to empty the hospitals and will need priority. The agencies and cabinets will be required to use their expertise to mitigate the infrastructure of the U.S. We found out FEMA are pencil pushers, so we have a 3 and 4 star prepared coordinate and act at the national level to the local level.

There is nothing wrong with Executive Orders per se. They are a necessary part of the executive process. However, Executive Orders must be backed by statutory and constitutional law. They cannot be used to enforce an executive whim which has no basis in the law. Sadly, this Executive, the one currently occupying the White House, is using Executive Orders to effect his whims. Are we surprised at this? We shouldn't be. He has spoken very clearly on the subject, lamenting the fact that the Constitution frequently stands in the way of his doing what "he knows" to be right and necessary. That's a sure fired indication that we are living under his whim in place of the law...
