Enlisted soldier and commander of the unit have a sexual relationship. Enlisted soldier contract ends and leaves the military, but still carries on a relationship for a couple years. The commander is still in the army. <br />Question: Since the CO is still in the army, can she be subject to UCMJ action? <br />Asking for a friend. I just don&#39;t understand why the regs here would be any different at all. Also, I may be an old fogey, but I strongly feel that this is not just a moral issue - it&#39;s also about security, respect and a maintaining a functioning COC, in my view. There are areas that explain and address NG issues. With that said there are limitations that some NG units ignore when it comes to senior leadership and family members in the same unit. In plain language the Army regulations apply. However, the Reserve Components were allowed to take exception to parts of these regulations. In general, people in the Reserve Components may fraternize when they are off duty and not subject to the UCMJ. Also, if the relationship predated either or both of the people joining the Reserve Component, then the relationship is not usually considered fraternization.<br /><br />Let me point out that this can create a challenging situation. Reserve Component units can be very tight organizations. Everybody may know everybody else&#39;s business. If Captain Smith is going out with SGT Jones on their civilian time it may be legal. However, if CPT Smith appears to offer any possible favoritism to SGT Jones during their official duties, then problmes may ensue. My recommendation is to be very careful about officer-enlisted relations on or off duty in Active or Reserve Component.
