Hmm... I could see this either way. Bottom line there are no facts around "he was there and he claims what he did broke no laws". With that, the burden of proof should be on the government. However, if there are intelligence matters involved, then it's understandable the cloak of secrecy involved.

That's why it'll be up to the courts to figure it out.

If it IS a case of the government abusing power, then I hope someone is nailed to the wall.
If it IS a case of this guy doing something he shouldn't be doing, then likewise the nailing.

I realize that this will appear to be at odds with my efforts to reform my interactions with everyone on RP ... however ...

Lets all get real for a minute. Treason and its practitioners seldom admit to others what they know themselves to be. If you consider our pro-Communist China government and activist judiciary (my opinion), justice is unlikely to follow. We are on the cusp of a "real" war with the PRC and not some police action. Any American with access to classified information should know better than to risk being compromised in this fashion.

Considering the warning from HM Government and the expressed concerns of MI6, if we can confirm that this man did actually travel to and from the PRC he should be tried for espionage and treason. If found guilty he should receive the maximum penalty under Australian Law for these offenses. If they give him back to us, he should be executed as an object lesson.

From here on out however, if another US Citizen, enemy handler, or intelligence officer should be likewise discovered, they should be dispatched out of hand (clandestinely* if possible, covertly* if not). What we don't admit to didn't happen. It's time to heat up the intelligence war in order to prevent an actual war.

* Covert and clandestine are two types of operations that are very confusing to most people although there is a significant difference between a covert operation and a clandestine operation. These types of operations can be conducted in the military, intelligence or law enforcement by a particular state or organization. A covert operation is an operation that is planned and executed in secrecy so that the identity of the agency or organization remains unknown. On the other hand, a clandestine operation is an operation that is carried out in such a manner that the operation remains in secrecy. As you can observe, the key difference between a covert operation and a clandestine operation is in the identity. In covert operations, the identity of the agency remains unknown while in clandestine operations the operation remains a secret.

..."Duggan’s next court appearance will be in Sydney in November to consider any bail application. Details of the US arrest warrant and the charges he faces are sealed.

“An individual was arrested on October 21, 2022, pursuant to a request from the United States of America for their provisional arrest,” a spokesman for the federal Attorney-General’s Department said in a written statement. “As the matter is before the courts, it would not be appropriate to comment further.”

The arrest came the same week Britain warned dozens of former military pilots to stop working in China or face prosecution on national security grounds under new laws. Australia is also investigating reports some of its former fighter pilots have been approached to work in China."...
