I''m not an FFL, I know we have some in the membership. Isn't one of the responsibilities of an FFL to determine the suitability of a customer. In refusing to sell, they open themselves to litigation, for sure, but in my mind, I think they have to determine, as the last line, whether or not the customer might be a danger to the community. Was purchasing the pistol online purely a matter of price? Or, was it a means of hopefully getting past the 4473 requirement???

Well, why doesn't he go shopping for a dealer who will institute the background check? Why not do that instead of publicly bitching about it?
I'll tell you why he's publicly bitching about it, because he damn well knows there won't be one FFL in his area, Southern and South Coast Oregon, who'll do it.
And since the ATF is now going after a FFL who sold the ATF a gun during the 'fast and furious' crapfest, nlhe probably won't find one anywhere.
