HOAs are legalized racketeering outfits, and need to be made illegal.

How does it make ANY sense for you to PAY a community to restrict your rights?

I will NEVER live in a HOA community again. Did that ONCE. Never again!

If my HOA told me to take down my US or my ARMY flag from the front of my house there would be a BIG problem in my neighborhood, and it wouldn't just be from me...there are several cops/firefighters/veterans and retired folks on my block in Colorado...none of us would stand for that...

I lived in a community with a HOA for seven years and I would never even consider it again. The HOA and I spent most of the seven years suing each other with mixed results.

The one HOA community I lived in sued me because I had a satellite dish (a small one) installed in MY backyard, not visible from the street in front. A HOA person trespassed on my property, sent me a notice of violation for not 1.) Getting an engineering assessment (which included surveying done by a civil engineer, blueprints of my property lot with the location of the satellite dish, to ensure that I wasn't over my property line) done prior, and 2.) Not applying for a permit to have said dish in my backyard. I cited the agreement that said that any semi-permanent additions to one's back yard should not be visible from the street. They replied by suing me. I appealed to the village court. The HOA's attorney somehow had me legally barred from directly contacting the village court. They didn't want outside legalities interfering. Long story short, I settled with them for $2,500 and still had to take down my satellite dish.

When one buys into the HOA, isn't this particular rule a rule already known prior? (I've heard this particular one many times) If so, then what the home owners are doing, and I hate to admit it, is wrong and they should be fined... This isn't about the HOA being unpatriotic, it's about home owners deciding not to follow rules they themselves agreed to... And are using patriotism to justify noncompliance...

The sad thing CPT Jack Durish is that they had to enact a law to prevent unpatriotic HOA's from enforcing un-American rules.

I guess we just read the law differently. There is no interstate commerce with regards to hate crimes either, but the government writes hate crimes legislation that affect all states. If burning the American flag has been deemed freedom of speech, displaying the flag is also freedom of speech. Where are our unalienable civil rights when arbitrary communities can ban freedom of speech?

A condominium association, cooperative association, or residential real estate management association MAY NOT ADOPT OR ENFORCE ANY POLICY, or ENTER INTO ANY AGREEMENT, that would restrict or prevent a member of the association from displaying the flag of the United States on residential property within the association with respect to which such member has a separate ownership interest or a right to exclusive possession or use.

LtCol (Verify To See) - Not always sit, apparently it is not the responsibly of the seller to inform the buyer of the rules just to inform the buyer of a association .

I specifically bought a home without an HOA. I will not accept someone telling me what I can or can't do on my property. I understand neighborhood aesthetics, but when they tell you not to fly the American, State, or Military flags... I will have a problem with those marxist associations.
