My son has autism and the teacher at his old school restrained him enough to leave bruising. I have started the process of taking the district to court over the incident. It did violate IDEA.

This was recent and it traumatized him. He will not allow any adults to touch him now. The school district immediately placed him into a good school with all the supports he needs including a behavioral therapist by his side in school.

He now has the supports he needs but my spouse was DA selected for recruiting. A move would be detrimental to my son's progress in school. His progress has improved dramatically since the change. Is this something severe enough that a request for compassionate assignment may be granted?

Moving my husband would also prove detrimental to his progress. This is something that I foresee to resolve, but at this point, it would create a very large situation. He is enrolled in EFMP. His diagnosis is three years old. My husband has re-enlisted since his diagnosis but his initial enlistment was prior the diagnosis. Thank you for any advice!

Clearly sounds like a case of abuse. Have you notified the State office for individuals with developmental disorders? Might be worthwhile to seek out a consultation with an attorney.

I contacted the State Office to obtain the incident report. The district is supposed to supply one to me within 5 days and it has been over 25 days. The state gave them until March 1st to supply or explain why they haven’t supplied an incident report. I am still waiting for that report. Once I have the report, the attorney comes into play. We do have documentation and photos the doctor took the day it occurred.

Hopefully you took your child to the doctors immediately following the incident and / or took photo’s of the bruising.

CW3 Jeff Held - Yes I have the documentation from the doctor from the same day as the incident and his testimony to what happened.

I hate to say this, but your family doesn't have to move with your husband, and that's very possibly the view HRC will take. Having your son enrolled in EFMP is an important first step. But there are other programs out there in places your husband could be stationed as well. Compassionate reassignment looks at moving people to the place they need to go, not stabilizing them in place.
