My spouse is saying they are starting phase 2 to kick him out for failing height & weight. He mentioned he was entrolled in the fat program twice in one year & claims he has no other option now that he failed the tape test but to get booted. Pleaseeeeee give me more info or explain better if you can. I’d like to help him reverse this process but i am civilian and can only do so much. Also should i get into contact with jag on post to help reverse process if possible? Thank you in advance

To be more specific: AR 600-9; Chapter 3-14 (b) If, after 12 months but less than 36 months from the date of release from the ABCP, it is determined that a Soldier again exceeds the body fat standard, a DA Form 268 will be initiated on the Soldier. The Soldier will undergo a medical evaluation (2) If no underlying medical condition is found, the commander will re-enroll the Soldier in the ABCP. The Soldier will have 90 days to meet the standards. Soldiers who meet the body fat standard at the 90-day point will be released from the ABCP. Soldiers who do not meet the ABCP body fat standard at the 90-day point are considered ABCP failures. Commanders will initiate separation action, bar to reenlistment, or transfer to the IRR per paragraph 3–12d for all Soldiers who fail to meet the body fat standard at the 90-day point.

JAG won't help, they work for the commander and process the chapter.
Reversing it would mean that your husband is within compliance of height and weight standards. It's hard to request the commander make a special exception for your husband if he isn't within compliance.

SFC (Join to see) not sure the commander has any slosh. A rewrite of the regulation in the late 1990s changed all the Commanders may to Commanders will. It seems to be retained in the current 2013 edition I got off APD today.

LTC Jason Mackay that's true, but when the commander's process it and if they do seems to vary wildly between units from what I've seen since the rewrite. I've seen where they take a very long time in order to give the SM an opportunity to fix it. This is at the company level. It's kind of like mandatory bars. They are mandatory, but if no one is pushing it, then it might not happen.
Of course, typically what really happens with height and weight is that the SM still fails to meet weight.

Rosie Rodriguez If he was in the program twice in one year as you say; lost 3-7 pounds per month until he made weight or body composition and removed from the program and this happened twice , then he is done. Army Regulation 600-9 is the authority to do so.

Edited comments: I initially answered this from my iPhone, I reviewed chapter 3 of AR600-9 and it is so. I direct your attention to Para 3-12, 3-13, and 3-14.

I am sorry to hear that this is happening. I have personally wrestled with AR600-9 since 1989. It is what it is and there is no real appeal or loophole out of its grasp. You're either in or or out of compliance. Crash weight lose often has the unintended effect of losing Neck circumference, which makes your body fat measurement go up. From your initial comment, it sounds like the command is sending him for medical evaluation. Looking at 3-17, there are urban legends about magical medical conditions that will get you around 600-9. They are just that, urban legends. Anything that would make you gain weight to that degree would be a serious thyroid or endocrine condition that would likely be very bad for you...worse than just busting tape. I've never seen a medical condition that would waive the regulation.

Short of a time machine, I don't see a way to reverse this as you asked.

LTC Jason Mackay he should receive an RE3 code with an honorable discharge. He'll even get to keep his GI Bill as long as he's served 3 years active duty.

Rosie Rodriguez not likely he will be able to return. If he can't keep the weight off now, there's little incentive for the Army to believe he'll keep it off later.
