I am pcsing to Benning in June and my wife and kids will be moving up to California for legal and health reason. I've used government moving before but for full government move, but never a dity. If I do dity, would I be able to move my family home. I would be paying out of pocket for when they move back with me, but for the time being, would it be possible to do the dity and have it covered?

They will only cover the max cost that it would cost for moving to Benning.
If this is for the health of your kids, then why don't you submit a request for a compassionate reassignment? Your orders can be delayed while you await the outcome of the decision.

I would do that, but it is more of a legal issue that would take a few months. At least till the beginning of the new year or I would.

SGT (Join to see) you said the health of your kids. You can request a compassionate reassignment for that

The Army will not pay you to do a Dity move to California because that’s not where you’re going to be stationed. Even though you’re doing it for legal reasons they are not responsible for moving your family to California you are. (No offense)

I am not a transportation guy, but will say there will be a good likelihood you will get paid for the distance of moving to Benning.
