So here is the situation:

I am currently stationed in Korea and have 28 months left of time in service. I am a first term soldier with 18 months time in service. I have orders to Fort Riley and do not want to go, is there anything I can do? I have attended my levy briefing. I can’t find a way to access the new DA PAM 601-280 regarding signing a DA 4991. From what I understand, I am ineligible for KAIP due to me coming to Korea directly after AIT, and I believe I am ineligible for a first termer statement due to the fact that I have the required SRR. Am I also ineligible for a DCSS due to my SRR?

A DA Form 4991 is a Declination for Continued Service. As in, you are on assignment but you don't have enough time in service to meet the assignment and would have to reenlist. For example, You had been in Germany for three years, your ETS was coming up in months and came down on orders for FT Riley. But, in order to meet that obligation, you would need to re-enlist. But since you don't want to go, that is when you sign a Dec Statement. Being that you are on a hardship short tour, with so much time remaining on your contract, the Dec Statement will do you no good. The only thing you can do is contact your Branch to see if they can find you another place to go. But.....don't hold your breath.

Thank you so much for your response SFC. This gave me the peace of mind I was looking for. I think it is absolutely insane for the person who is actually in that situation to follow through, and it helps a lot to know they'd have to go through such hoops to make it happen. Have a good night!

A DCSS only declines to reenlist. A first term statement does exactly the same thing but has no negative impact. Both require the SM to have an SRR that they dont have the time left to meet. Signing a DCSS won't do anything because the Career Counselor didn't give it to them, and the Career Counselor has to process it. They aren't eligible for a DCSS so it would just go into the shredder.
The SRR for returning from Korea is 6 months. The Soldier is already on assignment so the Army will not entertain an IPCOT or FSTE for them.
