I'm looking for specific regulations if any exist. I've been a 09B for almost two and a half years. My unit jacked up my MOS waiver (prior service) and now I'm stuck in limbo unable to attend BLC or mos training without extending. After dealing with all of this I'd prefer to take my services to another branch if possible.

24 months, AR 601-210 and ARNG PPOM 19-009.
However, due to COVID, DARNG is extending that to 36 months for this year.

Thank you for the response, but I can't seem to find it in there. I tried searching through the document with Ctrl+F and came up empty handed. Could please let me know which page it's on?

Chapter 3 Enlistment in the Regular Army, Army Reserve, or Army National Guard for Prior Service Applicants

3-18. General
a. PS Soldiers who fail to attend and complete IET within 24 months will be discharged.

Unfortunately you are going to remain in Limbo. It’s not a breach of contract because you can’t really say they aren’t trying. You could however request a 368 (conditional release) to active and then you would be priority for AIT

I don't know how the ARNG operates, or what his contract says, but when I left Active Duty and transferred to the USAR, my contract specifically stated that the unit had two years to send me to school (AIT) for the MOS I was transferring into. If the unit did not do that, the USAR would be in breach of contract, and I would have been free to either get out or re-negotiate my contract. He should definitely check his contract, sentence by sentence. Failing any ARNG action, writing a letter to his state Congressman/woman might help shake things loose.
