Can a soldier be flagged for civilian investigation even though the investigation is complete they are just pending a court date?

SM was on leave while the person watching their dog let the dog out and then later charged for animal cruelty but SM has the proof on their being no animal cruelty just pending court date.

Yes they can be flagged because there is no final disposition of the case. Once there is a final disposition, as in if the charges are dismissed or acquitted, then the flag will be lifted.
